What is a Notary

State through the power vested in the secretary
of by state law. The Notary has the power to
take acknowledgments, administer oaths and
perform other duties as permitted by laws.
Notary Publics must function within the
authority granted by the laws of their given
state even where fees for services rendered are
concerned.

What is a Notary Signing
Agent?
- A Notary Signing
Agent is a commissioned Notary Public who has
the skills and abilities through additional
training and experience, to assist lenders,
banks and signing companies with notarizing loan
documents.

Are
Notary Publics able to give Legal Advice?
- Notary Publics
ARE NOT ABLE TO GIVE LEGAL ADVICE. Notary
Publics are not licensed attorneys in the
practice of law, therefore they ARE NOT able to
give LEGAL ADVICE!

Are Notary Publics in their Signing Agent
capacity able to offer their opinions to a
borrower(s) in regards to loan documents?
- Notary Publics
performing in a Signing Agent capacity should
never give any information in regards to the
terms and conditions of any loan documents. The
Notarizing Officer should always refer the
borrower to the Lending Institution, should the
borrower have any questions to the terms and
conditions of the loan.

What is generally
acceptable proof of identification?
- Generally, two
pieces of identification must be provided one of
which MUST BE a picture ID. The following are
the most widely accepted forms of ID: State
Drivers License, State issued ID Card, U.S.
Passport and or Military Identification.
